Z tego względu jedynym producentem tych wyrobów na terenie Republiki Białorusi jest podmiot Grodno Azot, który zgodnie z rozporządzeniem 765/2006 od 2 grudnia 2021 r. znajduje się na liście podmiotów, które zostały uznane za odpowiedzialne poważnego naruszenia praw człowieka lub represje wobec społeczeństwa obywatelskiego i opozycji demokratycznej lub których działalność stanowi inne poważne zagrożenie dla demokracji lub praworządności na Białorusi lub też innych osób fizycznych lub prawnych, podmiotów i organów stowarzyszonych z nimi, jak również osób prawnych, podmiotów lub organów pozostających w ich posiadaniu lub pod ich kontrolą lub za czerpiące korzyści z reżimu Aleksandra Łukaszenki lub wspierające ten reżim, a także osób prawnych, podmiotów i organów pozostających w ich posiadaniu lub pod ich kontrolą. Grodno Azot to jedno z dwóch największych przedsiębiorstw chemicznych na Białorusi i kluczowy podmiot w regionie w produkcji nawozów azotowych. Dzięki dużej skali produkcji, Grodno Azot jest kluczowym dostawcą nawozów azotowych w regionie, co zapewnia firmie ważną pozycję na rynku. Eksport jest szczególnie istotny, gdyż przychody ze sprzedaży na rynki zagraniczne stanowią znaczną część zysków firmy. NFT LLC jest spółką pośredniczącą w obrocie mieszaniną mocznika i azotanu amonu w roztworze wodnym lub amoniakalnym (kod CN 3102 80 00 00), natomiast nie jest jego producentem. LLC NFT dokonując zakupu produktów od Grodno Azot (bezpośrednio lub pośrednio) a następnie je eksportując, narusza ograniczenia sankcyjne, które obejmują zakaz importu i eksportu produktów białoruskich pochodzących od sankcjonowanych podmiotów bez względu na kraj, firmę czy inne okoliczności pośrednictwa. Ponadto po umieszczeniu Grodno Azot na unijnej liście sankcyjnej podmiot ten zaprzestał eksportu do Polski. Jednocześnie inne podmioty (w tym LLC NFT), zaczęły eksportować do Polski towar o kodzie CN 3102 80 00, gdzie deklarowanym krajem pochodzenia jest Białoruś.
