(the “Manager”) subject to Chapter 15 of the amended Law of 17 December 2010 relating to undertakings for collective investment (the “Law of 2010”) and authorised as alternative investment fund manager according to the provisions of the amended Law of 12 July 2013 on alternative investment fund managers. This administrative fine is imposed following a thematic on-site inspection on the Manager, focusing on sustainability/Environmental, Social and Governance (“ESG”) aspects during which the CSSF identified persistent breaches in the internal governance framework of the Manager. The observations made by the CSSF concern five sub-funds of an investment fund under management (the “Fund”) which were classified by the Manager under Article 8 of the Regulation (EU) 2019/2088 on sustainability-related disclosures in the financial services (hereafter “SFDR”) and which, as such, promote “environmental and social characteristics”. As such, for the period from 16 February to 28 July 2023, the CSSF noted that the portfolio of the first sub-fund did not comply with the investment strategy described in the pre-contractual disclosures established in accordance with Article 8 of SFDR under the responsibility of the Manager. In relation to the other sub-funds of the Fund, the CSSF noted that the measures put in place by the Manager did not allow it to ensure that the different sustainable development goals (“SDGs”, as defined by the United Nations,) disclosed in the Fund’s prospectuses were effectively primarily targeted by these sub-funds. Consequently, the CSSF concluded that, at the time of the on-site inspection by the CSSF, the Manager did not comply with the provisions of : (i) Article 10(2) of the CSSF Regulation No 10-04 establishing administrative procedures and control mechanism of the management companies, supplementing Article 109(1)(a) of the Law of 2010; and (ii) Article 26(3) of the CSSF Regulation No 10-04 establishing rules of conduct of the management companies to act in the best interests of the UCITS, supplementing Article 111(a) and (b) of the Law of 2010.","sanctionType":null,"documentUrl":"https://registers.esma.europa.eu/publication/details?core=esma_registers_sanctions&docId=sn13422","validTo":null,"listingId":"13422","source":{"name":"ESMA Sanctions Register","entityType":"debarment"},"listKind":"debarment"},{"id":"c70988bf-b2b9-40b3-b29d-6931368fd355","entityId":"f286e8e1-14f9-44f4-bd8e-92c9a243c9d5","regime":"Commission de Surveillance du Secteur Financier (CSSF)","program":"UCITS","sourceId":"2a93add4-d591-4a24-a7f9-81e5124d2a2d","createdAt":"2026-09-12T19:14:25.252Z","lastSeenAt":"2026-10-23T12:00:09.031Z","delistedAt":null,"designatedAt":"2024-10-15T00:00:00.000Z","legalBasis":null,"reason":"En date du 15 octobre 2024, la CSSF a prononcé une amende d’ordre d’un montant de 56.500 euros à l’encontre du gestionnaire de fonds d’investissement Aviva Investors Luxembourg S.A.
