    Reason given
On 26 April 2022, the Netherlands Authority for the Financial Markets (AFM) imposed an order for incremental penalty payments on De Leeuwen & Partners B.V. (DL&P). The measure is imposed because DL&P is an accomplice to a violation of the Financial Supervision Act by an illegal, foreign broker. This illegal broker provides investment services in the Netherlands without having the required license. Accomplice to a violation of the license obligation for investment services DL&P approaches Dutch consumers, without being asked, with the offer to make use of a trading algorithm that trades automatically for the account of clients in foreign exchange derivatives. For these clients, an account is opened at an illegal broker, on which this illegal broker executes transactions or has transactions executed in financial instruments on behalf of these consumers without any intervention on their part. Due to the cooperation with DL&P, this illegal broker provides investment services to clients who reside in the Netherlands. This requires a license in the Netherlands, namely to provide portfolio management services. DL&P makes a substantial contribution to the violation by the illegal broker and therefore qualifies as an accomplice. Activities not ceased in time DL&P did not cease being an accomplice to the the illegal provision of investment services in the Netherlands by the illegal broker within the prescribed period. DL&P has therefore been obliged to pay the penalty payment since 5 May 2022. Every day that DL&P has not complied with the order imposed, the penalty payment to DL&P has increased by € 5,000. As of 14 May 2022, the penalty payment has increased to a maximum of € 50,000. DL&P has not complied with the order to date.
