[original (Dutch)] On 29 December 2016, the Authority of Financial Markets (AFM) imposed a fine of € 80,000 on ABF Advisory Group B.V. (ABF). Also, Mr. XXX, who is in charge of ABF, will receive a fine of € 5,000. The fines have been imposed because ABF has received an insurer's commission for mediation in funeral insurance. This has violated the commission ban. State of affairs legal procedure Penalty imposed Appeals Appeal Appeals Appeal Established Decision taken Settled Prediction made. Established Prediction made 29-12-2016 ABF: 03-02-2017 XXX: 06-02-2017 Disposed provision ABF Assurance Office has attempted to circumvent the commission ban by agreeing with an insurer that ABF's 4 employees were placed on her payroll list. The insurer has paid the employee's salary costs for one year. The customer base was sold to the same insurer for € 1. In fact, hardly anything changed. The employees continued to work from ABF's office and were run by XXX, who was also paid by the insurer himself (totaling € 64,377). The AFM therefore finds that there is a disguised commission. Customers are not notified of these appointments. The cooperation between ABF and the insurer has lasted from May 1, 2013 to May 8, 2014. Fine The AFM believes that in this case there is an average seriousness of the offense and an average offense of the offenders. The AFM finds a fine of € 100,000 for both ABF and XXX in this case appropriate. The fine for ABF has been reduced to € 80,000 and the fine for XXX is up to € 5,000 because they can not pay a higher fine. Purpose of prohibition Due to the prohibition on the provision of funeral insurance, customers pay their financial services provider directly today. Consultants and mediators may not receive any fee (commission) from this provider for this product. The prohibition clause ensures that the adviser or mediator can fully focus on the customer. ABF has just made the connection with the insurer exist. ABF and XXX have 6 weeks to object to the fine
