SGIIC for committing a serious infringement under Article 81(o) of Law 35/2003 of 4 November on Collective Investment Institutions. The infringement consisted of non-compliance with the obligation set out in Article 67(3), in conjunction with Articles 66 and 46(2) of the same law and its implementing regulation, by failing to verify that the settlement fees charged by six investment companies with variable capital (SICAVs) were equal to or better than market conditions (Article 67(3) of Law 35/2003), without prior authorisation of such fees from the general shareholders' meeting.
